Kickstarter terms

This has just been flagged up on the Kickstarter page (these terms were in place when this project was started). I didn't realise that there was actually a breach here (assuming that we never get the rewards or the refunds).

'A Project Creator is not required to grant a Backer’s request for a refund unless the Project Creator is unable or unwilling to fulfill the reward.
Project Creators are required to fulfill all rewards of their successful fundraising campaigns or refund any Backer whose reward they do not or cannot fulfill.'

But what to do about it? Who takes on Barnstorm to get our money back? I have to say anyone who thinks they are going to see ANYTHING else must be on weed or something. I suspect no chance at all. I just feel really sorry for the poor sod who bid £5k or whatever it was and only got a bleedin dinner out of it at Barnstorm's gaffe! Imagine how he is feeling.

My gut feeling insx is that this Kickstarter was done basically to get a large injection of capital into Barnstorm upon it's initial startup after predecessor company Silverball Studios went belly up.

I hate to say it, but:

A class action suit could be on the cards, but it wouldn't amount to much since Barnstorm have clearly dried up all the investment cash.
I have to wonder, as well, what the point was of getting a cash injection if you're just gonna blow it. They've obviously tried to make some sort of product, but for whatever reason they've burnt through that cash faster than a hoarder at a charity shop, and now they're high and dry. So when all's said and done, whatever their motivations, the money's gone.

No real point here, just some observations. In any case, I've emailed Ade (for what it's worth). See if we get a response.

I am a software developer myself and was skeptical when I saw all the rewards for the bit of money on Kickstarter. Of course, 49,000 pounds sounds like a lot of money. But realistically, how many people can live on it for how long? After all, they managed to release Pro Pinball for Windows, Mac, Android and iOS (and maybe even other operating systems). I suspect that the revenue from the sale of the software was too low, less than originally planned, and therefore there was no money left for the further game development and the production and distribution of the rewards.

It is a pity, of course, that Barnstorm simply pulls themselves out of the affair by not answering any more questions. But at least we got a playable version. That's the main thing for me. Of course time will show how long they will run without updates.
